Hi Guys
I had posted this in Ducatisti but also your opinion counts so here goes:

I had received an odd (for me) phone call. A guy from Swindon insurance called me about accident I had in 2007.

In short I was knocked off the bike by a car which changed lanes without looking, he did not stop. It was unavoidable as I was on the height of his rear doors. It came out the ford was stolen so I dropped the claim case.
Today a guy from Swindon insurance called me to ask me if I would like to recover my costs. For my question how he replied case against MIB.

What do you think is it worth it; can I only recover personal injury or cost of damage as well? I have no receipts for damage any more as I sold the bike with them to prove what was the actual damaged and what was repaired. Police was involved and there is a case number available, just need to retrieve it.
So again is it worth it?

Absolutely!!

Blimey I am sure they will understand you have moved on in various ways since this accident.

be reasonable in your claim and who knows?

Say you had a pre-production Desmo and you may have some issues though!

Well I was not going to over due it with damage as there is no point to much and they will slam the door. I think I will have a go any cash for Ducati is a good cash worth while.

i think you can only recover personal injury from the mib but i might be wrong, also the amount you will be paid will not be as much as an insurer would pay for a like for like injury.
 
this is from my limited involvment with such a case

you might also consider claiming form what i belive is called the criminal injuries compensation board / scheme , i think it may be that they might have to reject your claim for the MIB to take it up, although my experiance was many years ago, things may have changed now

Thx Bungi as I know only very limited and selected by me parts of law:
one mentioning that 2x speed limit = instant ban
second do not drink and drive
 
Rest is not that important so I will let them try it.

I would be careful as any claim made against an uninsured 3rd party is paid by an insurance company somewhere, this will have an affect on any future policies that you take out.

I was hit by an uninsured driver who disappeared and I got clobbered for the next 5 years even though I have protected no claims.
I am here all week and there are tapes on the foyer.
